Welcome to Gemini AI Photo Editor, a web-based platform for AI image generation, photo editing, background cleanup, watermark and object removal, and related creative tools. By accessing or using Gemini AI Photo Editor (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

Use of the Service

Gemini AI Photo Editor provides browser-based creative tools, generation credits, downloadable outputs, account history, and related APIs or workflows where available. You agree to use the Service only for lawful purposes and in compliance with applicable laws, platform rules, and third-party rights.

You are responsible for the prompts, images, files, and instructions you submit. You should only upload, generate, edit, or remove content when you have the legal right to do so.

User Accounts and Registration

1. Account Creation: You must provide accurate registration information and keep it current.
2. Account Security: You are responsible for maintaining the confidentiality of your login credentials. Notify us at support@geminiaiphotoeditor.app if you suspect unauthorized access.
3. Eligibility: You must be at least 13 years old, or the minimum age required by your jurisdiction, to use the Service. If you use paid features, you must be legally able to enter into a binding agreement.

Content and Intellectual Property

• Your Content: You retain ownership of images, prompts, instructions, and other content you submit. You grant Gemini AI Photo Editor a limited license to host, process, transmit, display, and modify that content only as needed to provide, secure, troubleshoot, and improve the Service.
• Generated Outputs: Subject to these Terms, your plan limits, and applicable law, you may use generated or edited outputs for personal or commercial projects. You are responsible for confirming that your use does not violate third-party rights, publicity rights, copyright, trademark, or platform policies.
• Our Technology: The website, software, interface, models, workflows, brand assets, and documentation are owned by Gemini AI Photo Editor or its licensors. You may not copy, reverse engineer, resell, or misuse the Service except as expressly allowed.

Prohibited Activities

You agree not to:

• Upload, generate, or edit content that violates copyright, trademark, privacy, publicity, or data protection rights.
• Use the Service for unlawful surveillance, harassment, impersonation, fraud, malware, abuse, or deceptive media.
• Create sexual content involving minors, non-consensual intimate imagery, or other illegal or exploitative content.
• Misrepresent AI-generated or edited content in a way that causes harm or violates applicable law.
• Circumvent credits, quotas, subscriptions, rate limits, security systems, or access controls.
• Scrape, overload, resell, or provide unauthorized access to the Service.

Pricing, Credits, Billing, and Refunds

• Paid plans, subscriptions, credit packs, or other purchases are billed through Stripe or other approved payment providers.
• Credits may be consumed when you submit generation or editing jobs, including jobs that fail because of user-provided inputs, policy violations, or third-party provider limits, unless the product states otherwise.
• Subscription plans renew automatically unless cancelled before the renewal date.
• Fees are non-refundable except where required by law or expressly stated in writing.
• We may change pricing, plan features, or credit costs with reasonable notice where required.

Service Availability and Changes

We work to keep the Service reliable, but we do not guarantee uninterrupted availability. Features, models, free tools, output quality, credit costs, and processing times may change as we improve the product or as third-party providers change their services.

Termination

We may suspend or terminate access if you violate these Terms, create legal or security risk, abuse the Service, or fail to pay required fees. You may stop using the Service at any time. After termination, stored projects or account data may be deleted according to our retention practices and legal obligations.

Disclaimer of Warranties

The Service is provided “as is” and “as available.” We do not warrant that outputs will be accurate, unique, suitable for a particular purpose, free of artifacts, or accepted by any third-party platform. Results depend on your inputs, selected tools, model behavior, and provider availability.

Limitation of Liability

To the fullest extent permitted by law, Gemini AI Photo Editor and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, business interruption, or reputational harm. Our aggregate liability for claims related to the Service will not exceed the amount you paid to us in the twelve months before the claim, or USD $100 if you did not pay for the Service.

Indemnification

You agree to defend, indemnify, and hold harmless Gemini AI Photo Editor and its affiliates from claims, damages, liabilities, costs, and expenses arising from your content, your use of outputs, your violation of these Terms, or your violation of third-party rights or applicable law.

Governing Law

These Terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules, unless consumer protection laws in your jurisdiction require otherwise.

Changes to These Terms

We may update these Terms to reflect product, legal, or operational changes. Material changes will be reflected by updating the effective date and, where appropriate, by providing additional notice. Continued use after changes take effect means you accept the updated Terms.
